Dear Judge James:
I recently reviewed the filing of my November 6, 2000 letters (actually filed by the Clerk November 9, 2000) and found error in the Record. Please see the attached NOTICE, dated December 1, 2000.
In addition, the Record currently shows that the Judge is "unassigned." (Attached, Exhibit A) Your letter of August 30, and Ms. Overcash's letter of September 12 clearly indicate that Judge Boyett signed and filed an ORDER OF APPOINTMENT OF SENIOR JUDGE, naming the Honorable Rufe E. McCombs. I have been proceeding in said direction, as evidenced by my pleadings of September 18, 2000.
However, I recently searched the docket for Judge Boyett's Order of July 6, 2000. The only pleading on the docket for either the signing date of June 5 or the filing date of July 6 is titled "Affidavit."
Am I to understand that the "Affidavit" is truly an "Order," thereby assigning said case to the Honorable Rufe E. McCombs; or, am I to understand that I must now Move the Administrative Court to complete the May 10, 2000 Order of the Honorable Kenneth O. Nix and assign this case to a Superior Court other than Cobb County?
Please identify the currently assigned Judge and the currently valid Clerk of Court for all pleadings.
