        RE: Civil Action File 99-1-7941-__ Portman vs. Kreeger, et.al

Dear Judge James:

Again, I appeal to you for clarification in the above named Civil Action. Please understand that it is not my desire to irritate the Court with repeated requests for clarification of the Record, yet the Record is sufficiently confusing to warrant these questions. 

When the Court provided me with a filed copy of the July 6, 2000 Order (signed June 5, 2000 by Judge William T. Boyett), I understood that Order to be part of the official Record. However, the Order does not appear on the docket of the Civil Action. Please identify the July 6 Order as either "a part of the official Record," or "does not exist in the official Record."

If the Order is part of the official Record, the very content of the Order specifically names the Honorable Rufe E. McCombs as the trier of the Action. However, the Record with the Clerk of Cobb County Superior Court clearly identifies the judge as "unassigned." Because of this conflict, please identify the assigned trier of the above named Civil Action. 

It is logical and proper that this instant letter would result in a timely clarification, thereby allowing me to proceed through the litigation. However, it is becoming increasingly evident that the Court is determined to delay this litigation. For the purpose of making this letter a proper part of the Record, and for the purpose of moving the Court to respond, I hereby include my request in the attached Motion for Clarification.
