You will recall that we have spoken twice about Ms. Portman's website at www.angelfire.com/ga2/portman. It is my position that some of the information on the site is false and maliciously defames me in my profession. It also constitutes libel under Georgia law, O.C.G.A. Section 51-5-1 et seq.

I am attaching hereto my letters to Ms. Portman and Margaret Gould Stewart, GM of Angelfire, dated February 7, 2000, for your reference. I have had no response to my letter to Ms. Gould.

It is my position that the allegations in Ms. Portman's pleadings in her lawsuit are false and defamatory. While they may be privileged because they are court filings, which I do not concede, I do not believe one is privileged to publish copies of pleadings elsewhere, such as on the Internet. Furthermore, there is no privilege I am aware of to publish things outside the pleadings, such as commentary which is slanderous. This would apply to the "Summary" posted on Ms. Portman's website.

She also has links on her site to another site, www.clr.org, which purports to list attorneys in Georgia who are guilty of legal misconduct. Somebody, probably Ms. Portman, had my name listed on that site as well, along with the names of other reputable attorneys and judges in this area. I am a member in good standing of the State Bar of Georgia, and have not committed any misconduct. Accordingly, I believe this link is libelous as well.

I am asking Lycos to take steps to remove this false and defamatory information immediately, as set forth in my letter to Ms. Gould. Please get back to me as soon as possible about this.
