Affidavit of Marquitta L. Portman in Support of her
Motion to Disqualify the Honorable Rufe E. McComb,
Senior Judge, State of Georgia

COMES NOW , Marquitta L. Portman, Plaintiff in the above styled matter, and files this her Affidavit in Support of Motion to Disqualify the Honorable Rufe E. McCombs and shows this Court the following:

1.

I am a citizen of the United States, and am competent to submit this Affidavit based on my own personal knowledge.

I am the Plaintiff in this action, Civil Action File No. 99-1-7941-__ (formerly Civil Action File No. 99-1-7941-35, formerly Civil Action File No. 99-1-7941-24). For the sake of brevity, all references to any of these three Civil Action File numbers are as if to the same.

By attachment to responding letter from Jody Overcash, Court Administrator for the Seventh Judicial Administrative District, (Exhibit A) I learned that the Honorable William T. Boyett had signed and filed an Order in the above styled case. (Exhibit B

Until Thursday, September 14, 2000, I did not have knowledge of the assignment of Civil Action File No. 99-1-7941-35 to the Honorable Rufe E. McCombs. Attached, as Exhibits C, D, E, and F is correspondence to and from the Honorable Robert J. James concerning the above styled case.

I was led to believe from Judge Nix's Order of May 10, 2000, Exhibit G, that Judge Robert J. James was the Administrative Judge of the Seventh Judicial Administrative District and that he would make the necessary assignment of the above cited case to a Superior Court judge outside the Cobb County Judicial Circuit. In truth, the Honorable William T. Boyett was the Administrative Judge of the Seventh Judicial Administrative District.

Assignment of a Senior Judge, State of Georgia to this instant case at bar, while leaving jurisdiction in the Cobb County Judicial Circuit, is evidence of bias, prejudice and conflict. The Record contains evidence of prior bias, prejudice and conflict in the underlying cases, Superior Court Civil Action File Nos. 94-1-5243-22, 96-1-0373-24, 96-1-2243-22, 98-1-6130-33, 99-1-0343-24, Juvenile Court File 76177-00, State Bar of Georgia Petition for Fee Arbitration and Grievance RE: Daryl Kidd, Court of Appeals Case No. A99I0090, and Georgia Supreme Court Case Nos. S99A0440 and S99C0504. All such actions are predicated on the Final Judgment and Decree from Civil Action File No. 94-1-5243-22.

I now show this Court that my Motion to Disqualify, Affidavit of Marquitta L. Portman, and Verification are timely filed, pursuant to Superior Court Rule 25.1.

I submit that my website, www.marquitta.com provides a copy of the accurate Record of Civil Action File No. 99-1-7941-35.

I take this opportunity to state that I never set out to attack any member of the Judiciary. What may be perceived as pro-active actions on my part as Plaintiff have actually been defensive actions to protect my rights under the Laws of the State of Georgia and under the United States Constitution. My goal was, and is, to seek the truth, do what is right under the Law, and protect my rights and the rights of my children. It is now my firm belief, after simply seeking a valid and justifiable divorce, that certain judicial officers seem to be more interested in covering up their own errors and omissions than completing their sworn duty. As this Civil Action progresses, more judicial officers are becoming subject to committing their own errors and omissions. I regret the involvement of some honorable and worthy members of the judiciary and I bear no ill will toward those who have now become my adversaries in this and other Civil Actions. It is amazing to me that not one has yet taken the risk to do the right thing. I would very much like to end this legal debacle, but cannot in good conscience do so until Justice is achieved.
