On letterhead from the Department of Law, State of Georgia, Seal of Thurbert E. Baker, Attorney General:

January 17, 2001

Honorable Rufe McCombs
Senior Judge, Superior Courts of Georgia
3305 Brownwood Drive
Snellwood, GA 30078

RE:  Portman v. Kreeger, et al., Cobb Superior Court, Civil Action No: 99-1-7941-24

Dear Judge McCombs:

I am profoundly sorry that I missed the hearing in the above case on January 16, 2001. I will spare you the long explanation. Suffice it to say that the long weekend, combined with a conflict that I did solve so that I could come to the above hearing, caused a failure of both my personal and computer memory.

After a conversation with Christine Daniel, I have discovered that you have scheduled hearings for arguments on some of the parties' motions to dismiss on February 15 and 16, 2001. This is a request that you hear argument on the judges' motions on one of those occasions if possible. If not, please schedule a time for the judges' motions to dismiss to be heard.

Please let me know if I need to provide further information with regard to the above. Again, please accept my apology for my absence on the 16th. I hope it did not cause any inconvenience to the Court.

Sincerely,
