RE: Civil Action File Number 98-1-6130-33

Dear Ms. Allen:

I have no personal quarrel with Judge Ingram or with her ability to act as trier of any case, except where she is both the defendant and the trier. I have not requested her recusal from Civil Action File No. 96-2243-34, nor from the underlying Civil Action File No. 94-1-5243-22. The Petition of Mandamus was filed because I have no other remedy. My action was clearly and simply a legal procedure in response to her repeated direction to prepare the Order.

I have been accused of having an idealistic allegience to our system of justice. I am not ashamed of my steadfast belief in the American system. I also know that my rights are available to me only to the extent that I accept them, and in some cases, pursue them.

It has become evident that a great number of honest people have been duped into participating in the continual cover-up which stems from the underlying case, Civil Action File No, 94-1-5243-22. Several attorneys have represented me, and although their intentions were good, they too have been caught up in a deceitful web of abuse and injustice, from which they have had to extricate themselves for their own survival. As much as I abhore their lack of courage and honor, I empathize with their personal duty to their own families.

I have been patient throughout this legal ordeal. Although my family and I have suffered greatly from the lack of judicial responsibility, it is also the delays which have caused the truth to surface. Just as I have proceeded with due diligence to this juncture, I will continue to act with due diligence to correct the original wrong.

Attached is a copy of my letter to Senator Chuck Clay, dated March 19, 1998, and the response from your office, dated April 9, 1998. Please advise me of the appropriate statutory law which provides for the representation of elected public officials by the Department of Law, State of Georgia.

Due to the events of the last several weeks, and most recently the events of Friday, August 28, 1998, I am compelled to file the attached Affidavit and Verification, Request for Jury Trial, Brief in Support of Request for Jury Trial, and Request to Remove Hearing of September 9, 1998.

I invite you to thoroughly study this case. I hope you will not be misled or deceived by those who participated in the subsequent cover-up. I am obviously not a trained attorney, but I am committed to pursuing both truth and justice. Although I still believe in the system, I have learned that it is the people who abuse it. Can you serve and protect the citizens of Georgia from corruption when that very corruption is within the judiciary?

Sincerely,

Marquitta Portman
Plaintiff
